Please read these Terms of Use (“Terms”) carefully before using Metkagram (metkagram.app), the website, and mobile applications for Android and iOS (collectively, the “Service”) operated by Metkagram (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Account Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as needed. You are responsible for safeguarding your password and for any activities or actions under your account. You must notify us immediately upon discovering any unauthorized use of your account.

2. Subscriptions

Metkagram offers subscription plans for access to premium features and content. By purchasing a subscription, you agree to pay the applicable fees and taxes. Subscriptions are billed in advance on a recurring basis and are non-refundable. We reserve the right to change the subscription fees at any time, and we will provide notice of any fee changes before they become effective.

3. Intellectual Property

All content, features, and functionality on the Service, including but not limited to text, images, graphics, logos, and software, are the exclusive property of Metkagram and its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works based on the Service without our prior written consent.

4. External APIs, Firebase, and Google Cloud Services

We use external APIs for text annotation and Firebase and Google Cloud services for the app. By using the Service, you acknowledge and agree that Metkagram is not responsible for the availability, accuracy, or content of these external services, and that your use of these services is subject to their respective terms of use and privacy policies.

5. User Conduct

You agree not to use the Service in any way that is unlawful, harmful, or otherwise objectionable. This includes, but is not limited to, using the Service to harass, defame, or threaten others; uploading or transmitting viruses, malware, or other harmful files; or violating any applicable laws, regulations, or guidelines.

6. Termination

We may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Changes to Terms of Use

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable advance notice of any material changes. By continuing to access or use our Service after those changes become effective, you agree to be bound by the revised Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflict of law provisions.

10. User-Generated Content and Data Storage

Metkagram allows users to add their own text to the app and create custom language cards for personalized learning. The user-generated content and data will be stored on Firebase, a Google Cloud service.

Access to User-Generated Content: Only the user who created the content will have access to it. We will not share, distribute, or disclose your user-generated content with any third parties without your explicit consent, except as required by law or in compliance with our Privacy Policy.

11. Account Deletion and Data Retention

Users have the right to delete their account at any time. Upon account deletion, all user data associated with the account will be permanently removed from our systems and cannot be recovered.

We reserve the right to delete user data, including user-generated content, if a user has no active subscription and has been inactive for an extended period of time. We will make reasonable efforts to notify the user before taking such action. This measure helps ensure efficient use of resources and system performance and security.

12. App Store Distribution

Metkagram’s mobile applications are distributed through app stores, such as Google Play Store for Android devices and Apple App Store for iOS devices. By downloading and installing Metkagram from these app stores, you agree to comply with the respective terms and conditions, guidelines, and policies of the app stores.

13. Contacting Users via Email

We may occasionally contact users via email for various purposes, such as sending important service announcements, updates, promotional offers, or newsletters. By registering for an account and providing your email address, you agree to receive such communications from us.

14. Communications

By using Metkagram and providing your contact information, such as your email address or phone number, you agree to receive communications from us, including service-related announcements, promotional messages, user support, surveys and feedback, and legal and administrative notices.

15. Updates to the Service

Metkagram reserves the right to update, modify, or enhance the Service at any time to improve its functionality, performance, and user experience. By continuing to use the Service after an update, you agree to be bound by any changes or modifications resulting from the update.

16. Third-Party Login Services

We offer you the option to access or log into Metkagram Services using your existing credentials for certain third-party websites and services. By choosing this option, you authorize us to collect, store, and use any information that these third-party services provide to us in accordance with our Privacy Policy.

The following third-party login services are currently offered:

• Facebook Connect: We may collect your basic account information (name, profile picture, email address, and Facebook ID). Facebook’s use of your information is governed by its Data Policy: facebook.com/legal/about/privacy.
• Google Sign-In: We may collect your basic account information (name, profile picture, email address, and Google ID). Google’s use of your information is governed by its Privacy Policy: policies.google.com/privacy.
• Twitter Login: We may collect your basic account information (name, profile picture, email address, and Twitter ID). Twitter’s use of your information is governed by its Privacy Policy: twitter.com/en/privacy.

When you use a third-party login service, you are sharing your information with that service. These third-party services may also collect information about your use of our Services. Please review their privacy policies to understand their data practices.

By using Metkagram’s Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, our Privacy Policy, and any other applicable policies or guidelines. You also acknowledge that you are responsible for complying with all applicable laws, rules, and regulations in your jurisdiction while accessing or using the Service.
